At the same time, however, it has generated a significant organisational and financial impact on amateur sports associations and clubs, which are now required to comply with new administrative, social security and tax obligations.<\/p>\n<p>The expansion of the scope of employment legislation has made the correct classification of relationships involving athletes, coaches, instructors and other operational personnel particularly sensitive. The distinction between self-employed collaboration arrangements, employment relationships and amateur sporting activities now requires careful legal assessment in order to prevent challenges during labour inspections or judicial proceedings.<\/p>\n<p>Compliance requirements relating to the National Register of Amateur Sports Activities (RASD), social security contributions payable to the relevant authorities, and the formalisation of contractual arrangements have become essential components of corporate governance within sports organisations. Any irregularities may result in the recovery of unpaid social security contributions, administrative penalties and liability on the part of directors and governing bodies, as well as potential consequences within the sports justice system.<\/p>\n<p>The principal challenge, therefore, lies in ensuring an adequate level of protection for sports workers without undermining the economic sustainability of the associations and clubs that form the foundation of the national sporting movement.<\/p>\n<p>A further area requiring particular attention concerns the development and promotion of young talent, which is particularly relevant in professional association football.<\/p>\n<p>The limited presence of Italian players developed through the youth academies of leading Italian football clubs raises questions regarding the ability of the system to convert investments in youth development into genuine professional opportunities. Whilst Italian football clubs legitimately pursue objectives of competitiveness and financial sustainability by frequently recruiting established players or players from foreign markets, which is particularly true in Serie A, such dynamics may adversely affect the growth of the national technical and sporting heritage.<\/p>\n<p>From a regulatory perspective, the issue encompasses the legal framework governing youth academies, training and development compensation schemes, as well as the solidarity and compensatory mechanisms provided for under both Regulations of National Federations and international sporting rules, such as the FIFA Regulations on the Status and Transfer of Players. The objective pursued by sporting institutions is to identify an appropriate balance between clubs\u2019 managerial autonomy, principles of competition law and the broader public interest in the development of sport.<\/p>\n<p>The increase in costs arising from the new sports employment framework must also be viewed against a backdrop of significant financial challenges affecting many sports organisations.<\/p>\n<p>The sustainability requirements imposed by sporting governing bodies, the procedures governing admission to competitions, and the monitoring of compliance with salary and social security obligations have assumed an increasingly central role in sports governance.<\/p>\n<p>Failure to comply with economic and financial parameters may result in substantial consequences, ranging from disciplinary sanctions and restrictions on player registration to sporting penalties and, in the most serious cases, exclusion from competitions.<\/p>\n<p>Accordingly, the management of legal and financial risk has become a strategic priority for clubs and executives, who are required to implement organisational models that comply with both statutory provisions and sports regulatory requirements.<\/p>\n<p>The legal framework governing the duration of sports employment contracts has recently undergone further development through the so-called Sports Decree (Decree-Law No. 96\/2025) and the relevant collective bargaining agreements, including the one in Serie A.<\/p>\n<p>The extension of the maximum contractual term to eight years introduces new opportunities for the technical and financial planning of sports organisations, enabling longer-term investment strategies.<\/p>\n<p>However, this increased contractual flexibility also raises delicate issues of interpretation concerning the balance between clubs\u2019 organisational requirements and the protection of athletes\u2019 professional freedom.<\/p>\n<p>Particular attention will need to be paid to the regulation of financial clauses, termination mechanisms and retention obligations, to ensure that contractual relationships maintain an appropriate equilibrium between the parties.<\/p>\n<p>In conclusion, the evolving regulatory landscape requires specialist expertise in contract management, regulatory compliance and dispute prevention and resolution.
